Redundancy advice

    My job went wallop last nov and the liquidator is sorting out all our redundancy payments etc

    Anyway I told her I was due €5000 in bonuses that I never received, now in the 2 years I was with them I never had any written employment contract given to me even though I tried many times. Do I have any leg to stand on as the liquidator seems to think I'm up against it???

    Not sure if it comes under the rights commissioner's remit ger but I'd look in to going down that route.it might take a while but you'll get your day in the labour court.
    I was in dispute with my employer for over 3 years and everyone told me I wasn't going to win,my union wouldn't even represent me.I knew I was in the right and stuck to my guns and 2 days before we were due in the labour court we came to an agreement..;)

    Hi mate,

    I'd imagine you'd have some evidence to support your claim that you worked there - anything like payslips, records of bank transfers for your former employer lodging regularly into your account etc, but do you have anything to verify the bonuses due (emails, or even a former colleauge who would support your claim perhaps ?)

    There must be a solicitor or two here on the site, who could give you a bit of half decent advice. Failing this, are you a member of a trade union - as they would have good advisors who might be able to help you ?

    Also, try Citizans Advice (they've a very good website) and even consider posting on the likes of AskAboutMoney.com or Boards.ie - you'll sometimes get decent advice on those sites from people in the industry.

    Willie's suggestion also sounds like a good one, btw.

    Yeah but your employer was still going?? This crowd went bang so it's a liquidator I'm dealing with so labour court won't even come into it,

    @garrett,

    I've proof that I worked there and all but no proof of a promised bonus payment

    Sorry to hear mate. My wife lost her job not long ago, went liquadation aswell as was due a decent redundacy payment but all she will get is statutory entitlements. Unfortuntely the employees are looked after last in these situations.

    Studying HR in college and Employment Law is one of the subjects. When we were looking at case law on redundancy as far as I remember when there was no written contract the courts were taking that the company paying you on a regular basis (weather it's weekly, fortnightly or monthly) as an implication there was an agreement of employment. So that should be your proof of employment just because a contract is not written it still exists. As for the bonusses were others in the company paid them?
