Just wondering if anyone here has been made redundant in the past as have query. Won't go into all details, but anyway missus was made redundant from where she worked for just over 2 years, place gone into liquadition. Employer has said that liquaditor will pay her what is owed in wages and redunancy, but from my understanding is that the employer must pay a lump sum. Because the missus and employer were friends I think she is using that in her favour. Have been told several times that liquaditor would be in touch but nothing so far, last week wife decided to ring liquaditor and they confirmed that they were still going through paperwork. My concern is that the employer should have paid a lump sum but she has walked away from it and wife wont push it with her. I dropped an email tonight to employment rights and hopefully will hear from them tomorrow, just looking to see if anyone here ever had experience of this probleam, cheers.
was made redundant from Zoe Developments, after 15 years. Company went bang. Had to wait approx 6 months for my redunancy to come through. got it from the state. Only entitled to statuory redundancy. Which is 2 payments of €600 for every year that you worked plus a final €600.
think I was waiting for about 6/8 months for mine to come through. I think she should get a letter when the paper work is put through.
Thanks Joey. Probleam we have here is that the employer is saying it has nothing to do with her and it is all with liquaditor. One question for you, when you left did you receive RP50 form when you left.
If you check the redundancy form below, you will see a section at the bottom right of page one which can be completed if the employer/administrator has not paid the redundancy.... http://www.maddenco.ie/downloads/LTD/Form-RP50-Redundancy-Claim.pdf Basically, I'm nearly sure your wife is protected in the event an employer won't pay. Employers did get a 60% rebate but this was amended to 15% from 01/01/12..... Employment Rights should keep her right though, so you've done the right thing there. Good luck!
When a company goes into liquidation they hand over all control, they couldn't pay the staff even if they wanted to. From what I remember the liquidator sends out the form, you fill in a couple of details and send it back. Like others, wait was about 6 months.
was in the same situation in nov, basically the employer is obliged to pay nothing. You need an rp50 form from the liquidator to send into the social, you need to be employed more than 104 weeks, maximum of 2 weeks per year at a maximum of 600pw plus 1 extra week. 2 years = 2400 +extra week = 600 total 3000
